Guest Release and Hold Harmless Agreement

Will Rogers Equestrian Ranch Homeowners Association (hereinafter the "Association")  and its Members and the Residents in the Community welcome the Guests of said Members and Residents (hereinafter "Guest" or "Guests") to the Association's Equine Facilities. All Guests must complete and sign this Guest Release and Hold Harmless Agreement (hereinafter the "Release") before entering the Association's Equine Facilities and before participating in any equine-related activities. In conjunction with executing this Release, Guest agrees to observe and abide by all rules, policies, and procedures in place for the Association's Equine Facilities. Copies of such rules, policies and procedures are available for Guest's review in the Association Equine Facilities' Office located at the northwest corner of the Ranch House. Guest also acknowledges that he/she has read and understands the "Limited Liability of Equine Owners and Owners of Equine Facilities" law codified as A.R.S § 12-553, a copy of which is available in the Association Equine Facilities' Office.

For purposes of this Release, "equine-related activities" include, but are not limited to, visiting the Association's Equine Facilities, visiting horses, petting horses, riding horses, lunging horses, feeding horses, and cleaning horse stalls or stables. For purposes of this Release, the terms "equine or "horse" may be used interchangeably and shall refer to all equines that may be located at the Association's Equine Facilities including horses, ponies, mules, hinnies and donkeys.

Guest hereby acknowledges and understands that there are inherent risks involved in visiting the Association's Equine Facilities and in participating in equine-related activities. Such risks include but are not limited to, horses becoming loose and running around the facility, tied horses kicking out, horses jumping, riders losing control of their horses, etc. Horses are living, breathing creatures with minds of their own, and their handlers and riders may not always be able to predict what a horse's behavior may be, predict how a horse may react to surrounding activities, or anticipate and appropriately respond to a horses's reactions and other behaviors.

Guest hereby acknowledges and understands that visiting the Association's Equine Facilities and participating in equine-related activities are dangerous activities and involve risks that may cause serious injury or death to Guest or another person because of the unpredictable nature and irrational behaviors of horses, regardless of their training and past performance.

Guest voluntarily assumes the risk and danger of injury or death inherent in visiting the Association's Equine Facilities and participating in equine-related activities.

Guest hereby waives, releases, and forever discharges the Association and/or its directors, officers, managers, agents, employees, or contractors (hereinafter "Releasees") from and against any and all responsibility or liability for claims, demands, damages, costs, causes of action, injury, including death, or damages (hereinafter "Claims") arising out of or in any qay related to Guest visiting the Association's Equine Facilities and participating in equine-related activities.

Guest hereby acknowledges that he or she has read this Release in its entirety, that Guest understands that this Release is a promise not to file suit against Releasees and a release and indemnity of the Releasees for all claims that Guest may bring in relation to his or her visit to the Association's Equine Facilities and participation in equine-related activities. Guest hereby acknowledges that he or she has made a free and deliberative choice to sign this Release as a condition to Releasees permitting Guest's access to the Association's Equine Facilities and Guest's Participation in equine-related activities. Guest has concluded that the risks involved and this Release are appropriate consideration for gaining access to the Association's Equine Facilities and for participating in equine-related activities.

Consent for Electronic Signatures and Information Storage

By proceeding, you agree to the following terms regarding electronic signatures and the storage of your information:

  1. Electronic Signatures: You consent to the use of electronic signatures in place of handwritten signatures for all purposes. You acknowledge that electronic signatures are legally binding and enforceable.

  2. Information Storage: You consent to the electronic storage of your personal and transaction information. This information will be securely stored and used solely for the purposes of processing your transaction, maintaining records, and fulfilling legal and regulatory requirements.

  3. Access and Security: You understand that we employ industry-standard security measures to protect your information. You have the right to request access to your information and to correct any inaccuracies.

  4. Withdrawal of Consent: You have the right to withdraw your consent to electronic signatures and information storage at any time. However, withdrawal of consent may result in the inability to proceed with certain transactions that rely on electronic processes.

By submitting this form you confirm that you have read, understood, and agree to the terms outlined above.

This form shall be electronically submitted to the Association Equine Facilities' Office located at the northwest corner of the Ranch House prior to any Guest's entry into the Association's Equine Facilities.
